fbDownloader END-USER LICENSE AGREEMENT

This End-User License Agreement ("EULA") is a legal agreement between you, either a single end-user or a single entity, and http://fbdownloader.com (“fbDownloader”). By installing the fbDownloader computer software and accompanying user documentation (the "software"), you are indicating your acceptance of all the terms and conditions of this EULA. If you do not agree to any of the terms or conditions of this EULA, do not install or use the software.
1. PAID LICENSE. This clause applies if you have purchased a license from an authorized source. The licensed version of fbDownloader does not display advertising messages. fbDownloader grants you the following limited, non-exclusive rights. You may download, install and use the fbDownloader software up to three (3) times with the license key provided.

2. FREE LICENSE. This clause applies if you are using the free version of fbDownloader downloaded from the fbDownloader website. fbDownloader grants you the following limited, non-exclusive rights. You may install and use the software on any computer.
After clicking "Accept" you will be offered additional useful, quality software provided by our reputable partners. Your support of these software offers allows us to provide you with Free access to our software. All offers we present are 100% optional.
3. OTHER RIGHTS AND LIMITATIONS
a) You may not lease, rent, sell, redistribute, sublicense, or lend the software. You may terminate this EULA at any time, or fbDownloader may terminate this EULA if you breach any of the terms or conditions of this EULA. In either situation, you must destroy all copies of the software.
b) You may not modify any of the fbDownloader executable files or databases;
c) You can’t use fbDownloader for any illegal purposes.
4. COPYRIGHT. The software is owned by fbDownloader, and is protected by international copyright treaties, as well as other intellectual property laws and treaties. The software is licensed, not sold. All rights not explicitly granted under this EULA are hereby reserved.
5. NO WARRANTY. The software is provided "AS IS" without warranty of any kind, either express or implied, including, without limitation, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement. The entire risk arising out of use or performance of the software remains with you.
6. WEB LINKS/ADVERTISING. The free version of fbDownloader (refer to Clause 2) may contain advertisements that when clicked take you to Internet sites managed by third parties. By activating these links, you are no longer using the fbDownloader software program. fbDownloader has no control over Internet sites owned by third parties. These sites are managed entirely by third parties and fbDownloader cannot make any declaration whatsoever concerning the quality or overall content thereof, nor regarding the quality of the products offered, or the security of performing transactions on the sites in question. The fact that third party sites are identified on fbDownloader software should not in any way be interpreted as an endorsement by fbDownloader .
fbDownloader cannot be held liable for possible damages arising from the use of such third party sites. All complaints about third party sites should be addressed to the administrators of those sites.
7. COLLECTION OF PERSONAL DATA. fbDownloader collects demographic information from you including gender, age and location data, for the purpose of selecting suitable advertising messages. This demographic information is not sold nor provided to any third parties under any circumstances. fbDownloader may also collect usage data on a periodic basis. This information is used to improve our products and services.
8. LIMITATION OF LIABILITY. fbDownloader shall not be liable for any special, incidental, indirect or consequential damages arising out of the use, or inability to use the software. In any case, fbDownloader’s cumulative liability shall not exceed the amount paid by you for the software.

fbDownloader is committed to protecting your privacy, while providing you with leading edge software utilities. This privacy statement explains the data collection and use practices of fbDownloader. This statement focuses on features in fbDownloader that communicate with the Internet and does not apply to data collected through other online or offline fbDownloader sites, products, or services. Information that is collected by or sent to fbDownloader may be stored and processed in Canada, the United States, or any other country in which fbDownloader or its affiliates, subsidiaries or agents maintain facilities, and by using an fbDownloader product, you consent to any such transfer of information outside of your country. fbDownloader abides by the safe harbor framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of data from the European Union. fbDownloader may disclose personal information about you if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on fbDownloader; or (b) protect and defend the rights of fbDownloader (including enforcement of our agreements). Collection and Use of Information about Your Computer and Photos fbDownloader contains Internet-enabled features that collect certain standard information from your computer ("standard computer information") and send it to fbDownloader. Standard computer information typically includes information such as your IP address, operating system version, fbDownloader version and your regional and language settings. If fbDownloader sends information to fbDownloader, standard computer information may be sent as well. fbDownloader also collects various usage-related information such as the number of photos you are managing with the product. This usage information is used to improve the product and is not shared with third parties.

Advertising in fbDownloader
When you use fbDownloader you will see advertisements that are periodically updated. Advertisements in fbDownloader typically come from third-party ad servers or ad networks. fbDownloader sources display advertisements from these companies to deliver to the fbDownloader software. Some of these ad networks may place a persistent cookie on your computer in order to recognize your computer each time they send you an advertisement. A cookie is a small text file that is placed on your hard disk by an online server. Cookies contain information that can later be read by an online server in the domain that issued the cookie to you.
